Learner and Driver Development Terms and Conditions

Please read this carefully.


The instructor shall provide the pupil with driving tuition at a lesson rate from time to time agreed.

It is hereby expressly agreed that this contract is made solely between the instructor, as principal, and the pupil. All Driving Ambition instructors are self-employed franchisees of Driving Ambition Limited.

Payment for tuition should be made in advance by cheque either direct to Driving Ambition Ltd or to the instructor, but in either case must be made payable to Driving Ambition Ltd. Alternatively the pupil may pay the instructor in cash or by cheque (made payable to Driving Ambition Ltd ) at the commencement of each lesson. Driving Ambition Ltd cannot accept any responsibility for any payments of cash made, or cheques made payable, to the instructor.

All matters relating to the timing, location and duration of individual lessons shall be subject to agreement between the instructor and the pupil.

The instructor shall have the right to rearrange any appointment to a time convenient to both parties if the instructor is not available for any reason.

Lesson cancellations can only be made by the pupil at least two clear working days (excluding Saturdays, Sundays and Bank Holidays) prior to the commencement of the lesson – where such notice is not given the pupil shall be liable for the full lesson fee unless it is waived at the absolute discretion of Driving Ambition Ltd.

Total lessons booked exceeding six hours in any seven day period shall be deemed to be an Intensive Course. A deposit of 50% of the course fee is payable at the time of booking. The balance must be made in full 30 days prior to the commencement of the Course. Cancellations made within 7 days of the Course commencing will not be due a refund unless supported by a relevant doctor’s certificate in which case a 50% refund will be made. Cancellations made between 7 and 14 days before the course commencing will be due a 50% refund. Where a refund is not required Driving Ambition will make every effort to offer an alternative date convenient to both parties.

The pupil undertakes that he/she holds a valid licence to drive the tuition vehicle.

The pupil is responsible for ensuring that they comply with the legal requirements for eyesight and any corrective lenses are worn at all times whilst driving.

The instructor shall have the right to substitute another Driving Ambition Franchised Instructor for the purpouses of giving all or some of the lessons if the instructor is not available for any reason whatsoever.

Practical Driving tests shall be arranged with the Driving Standards Agency (D.S.A.) by Driving Ambition Ltd or the instructor - full payment is required prior to booking.

The instructor reserves the right to withold the use of the tuition vehicle for the driving test, if in his absolute discretion he conciders the pupil has not reached a satisfactory stage of driving competence.

Driving Ambition nor its Franchised Instructors accept any responsibility for driving test appointments postponed or cancelled by the D.S.A., or for missed driving test appointments.

The instructor must be notified immediately if the pupil does not receive a test date appointment letter from the D.S.A. within seven days of booking the test.

If a pupil wishes to postpone or cancel a driving test the instructor must receive a minimum notice of 14 clear working days.

Practical tests booked through a Driving Ambition franchised instructor must only be taken in a Driving Ambition Vehicle.

The instructor reserves the right to refuse driving tuition, or terminate at any time a pre-paid course of tuition (subject to the repayment of fees for lessons not taken) without giving any reason.

Driving Ambition nor its instructors shall accept any liability for any loss, damage, or injury arising inside or outside a formal lesson, except to the extent that such liability is imposed by the laws of England. Adequate insurance is maintained by Driving Ambition and its Franchised instructors.

For the purposes of this Agreement any reference to the masculine gender shall include the masculine, feminine and neuter genders.

All complaints against the instructor or Driving Ambition Ltd must be made in writing within 14 days of the incident to:- Driving Ambition Ltd, The Boskage, 7 Chestnut Parade, Shepton Mallet, Somerset BA4 4DW.

In making any bookings, supplying any information or documentation to the pupil, and processing any payments Driving Ambition Ltd act as agents of the Instructor, and accordingly, the pupil acknowledges that Driving Ambition Ltd can not have any liability to the pupil in respect of any matter which is subject to the contract between the pupil and the instructor. For the avoidance of doubt, however, nothing in these terms shall exclude the liability of Driving Ambition Ltd for loss or damage directly occasioned by its negligence or other breach.

These terms and conditions represent the entire understanding of the parties.
